Terms of Service

1. Acceptance of Terms

By accessing or using LoveJoy, you agree to be bound by these Terms and our Privacy Policy. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization.

2. Eligibility

You must be at least 18 years old to use LoveJoy. By using the Service, you represent and warrant that you are 18 or older and have the legal capacity to enter into these Terms. We do not knowingly permit minors to use the Service.

3. Your Account

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You must provide accurate and complete information when creating your profile and keep it up to date. You may not create multiple accounts, share your account, or use another person's account without permission.

We may suspend or terminate your account if we believe you have violated these Terms or if your conduct harms the Service or other users.

4. User Conduct

You agree not to:

- Harass, abuse, stalk, threaten, or defraud any other user. - Post or transmit hate speech, explicit sexual content, violence, or illegal activity. - Impersonate any person or entity, or misrepresent your identity, age, or affiliations. - Use the Service for commercial solicitation, pyramid schemes, or spam. - Attempt to circumvent any safety or security feature of the Service. - Reverse engineer, scrape, or interfere with the Service or its infrastructure.

We reserve the right to investigate and take appropriate action, including removing content and banning accounts, for violations of these rules.

5. Content and Licenses

You retain ownership of the content you submit to LoveJoy (such as photos, bio text, and messages). By submitting content, you grant us a non-exclusive, royalty-free, worldwide license to use, display, reproduce, and distribute that content solely to operate and improve the Service.

You represent that you have all necessary rights to the content you post and that it does not violate any third-party rights or applicable laws. We may remove content that violates these Terms or that we deem inappropriate.

6. Subscriptions and Payments

LoveJoy+ and other premium features are available via in-app purchases processed by Apple through the App Store. All purchases are final and subject to Apple's terms and refund policies. We do not receive your full payment card details.

Subscriptions auto-renew unless canceled at least 24 hours before the end of the current period through your Apple ID account settings.

7. Safety

LoveJoy includes safety features such as Safety Check-Ins and reporting tools. These tools are provided for your convenience and do not guarantee your safety. You are responsible for your own safety when meeting people offline. We strongly encourage you to follow best practices for safe dating.

If you feel you are in immediate danger, contact local emergency services.

8. Termination

You may delete your account at any time through the app. We may suspend or terminate your account, with or without notice, for conduct that we believe violates these Terms or is harmful to other users or the Service.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

9. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.

We do not guarantee that the Service will be uninterrupted, secure, or error-free, or that any match or interaction will lead to a successful relationship.

10. Limitation of Liability

To the fullest extent permitted by law, Upstager Consulting Inc shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service, even if we have been advised of the possibility of such damages.

Our total liability to you for any claim arising from these Terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, or $100 if you made no payments.

11. Indemnity

You agree to indemnify and hold harmless Upstager Consulting Inc and its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to your use of the Service, your content, or your violation of these Terms.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to its conflict of laws principles. Any dispute arising from these Terms or the Service shall be resolved in the state or federal courts located in Florida, and you consent to the personal jurisdiction of those courts.

13. Changes to Terms

We may update these Terms from time to time. We will post the revised Terms with a new "Last updated" date. Your continued use of the Service after the changes become effective constitutes acceptance of the revised Terms.
